TFL and Choice Privileges Program

Terms & CONDITIONS

These Terms and Conditions (“Terms”) govern the earning and redemption of Choice Privileges points (“Points”) available to Choice Privileges members (each, a “Member” or “you”) through the Choice Privileges Rewards Program offered by Choice Hotels International, Inc. (“Choice”) or the purchase of tickets through the website (including related applications or platforms) (the “Site”) made available by TFL, LLC (“TFL”, and collectively with Choice “we” or “us”). TFL and Choice have partnered to offer this redemption program specifically to Members purchasing tickets on the Site (the “Program”).   These Terms apply specifically to Site usage and purchases made through the purchase of tickets or Point redemption by Members who are eligible to participate in the Program (Member eligibility is subject to Choice Privileges’ separate terms and conditions). If you are not a Member over the age of 18 meeting all eligibility requirements or do not agree to these Terms, you may not participate in the Program. By participating in the Program and purchasing tickets through the Site, you hereby acknowledge and agree as follows:

  1. Site Description and Acknowledgments.
    1. The Site acts as a marketplace offered by TFL that serves as an intermediary between buyers and ticket sellers (“Sellers”) to facilitate the purchase and sale of event tickets. Accordingly, (i) Choice, and (ii) TFL, solely in its capacity as the administrator of the Site, are not directly involved in the actual ticket transaction between the buyers and Sellers. Choice has no control over the Site, its functionalities or any of the types or availability of tickets offered through the Site, and Choice shall not have any responsibility or liability in connection with the Site, tickets or any transactions occurring through the Site.
    2. By using or visiting the Site or purchasing tickets in any manner in connection with the Site, you (i) expressly agree to abide and be bound by these Terms, as well as all applicable laws, ordinances, rules and regulations, and (ii) represent and warrant that you are at least 18 years old. You acknowledge and agree:
    3. Choice and TFL reserve the right to modify or change these Terms at any time, effective immediately upon posting notice on the Site. If Member violates these Terms, Choice and/or TFL may, without limiting their other rights and remedies available under these Terms or at law or equity, (i) terminate Member's access to the Site, (ii) suspend or terminate Member’s Choice Privileges membership, (ii) bar Member from future use of the Site and/or participation in the Program, (iv) cancel Member's order(s), and/or (v) take appropriate legal action against Member.

  2. Eligibility. Only Members in good standing (according to the applicable Choice Privileges program terms and conditions) are eligible to redeem Points for tickets through TFL. Redemption is subject to Choice Privileges Rewards Program rules and availability. You must log in to the Site using your Choice Privileges account credentials and follow the instructions provided on the Site to complete a redemption. Choice reserves the right, at its sole discretion, to modify, suspend, or terminate the Program, Site or these Terms at any time, with or without notice to you. Notice of material changes will be provided via the Choice Privileges website: https://www.choicehotels.com/choice-privileges/rules-regulations for direct Member communication.

  3. Point Earning and Redemption Process.
    1. Earning Points. Members may earn Points for qualifying ticket purchases made through the Site. The number of Points earned per transaction, and any applicable earning exclusions, will be disclosed at the time of purchase. Points earned for eligible purchases will be credited to your Choice Privileges account within 40 days after the event has been completed. Delays may occur due to processing, verification, or fraud prevention measures.
    2. Redemption. Points may be redeemed to purchase tickets for select events and venues as offered on the Site by TFL. The number of Points required for purchase, minimum redemption thresholds (which will be designated on the Site), as well as any delivery, service or convenience fees and taxes, will be specified at the time of checkout for transaction. Such additional fees and taxes will not be included in or covered by any Points redemption and must be paid separately by Member.
  4. Ticket Pricing, Sales and Cancellation.
    1. Final Sales. All sales are final. Since tickets are a one-of-a-kind item and not replaceable, there are no refunds, exchanges, returns, or cancellations. If an event is postponed or rescheduled, tickets will be honored for the rescheduled date. New tickets generally will not need to be issued; in the rare case that new tickets are needed, Member will be contacted by us. All orders placed on the Site or with the Site’s customer support team are considered pending, until confirmed by the applicable Seller.
    2. Event Cancellation. If an event is cancelled without a rescheduled date, Member must contact us at +1 888-519-6282 or support@choiceaccesstickets.com for a refund and refund eligibility and the method of refund (Points or monetary equivalent) will be determined on a case by case basis by us. We may require Member to return their tickets at Member's expense before receiving any refund Member is entitled to due to cancellation. Refunds will be processed in the same currency as the original order. We will not issue exchanges or refunds for lost, stolen, damaged, or destroyed tickets. If Member receives physical tickets, Member should keep them in a safe place.
    3. Refunds. If a ticket purchase is refunded, partially refunded, or canceled, the Points earned for that transaction may be deducted from your Choice Privileges account. Choice reserves the right to adjust Points in the event of refunds, cancellations, or suspected misuse. You acknowledge and agree that if an event or transaction is cancelled, any Points earned or redeemed by you for transaction or event may not be reinstated to your Choice Privileges account unless specifically stated otherwise by Choice, and neither Choice nor TFL shall be liable for any losses incurred by you as a result of such event cancellation.
    4. Pricing. Tickets available through the Site are made available by third parties (and not by Choice or TFL) including without limitation through secondary market Sellers, TFL partnerships or integrations. You acknowledge that we may not have authority or discretion to control the listing prices for such tickets depending the applicable third-party Seller. Ticket prices may be above or below the 'face value' listed on the ticket. All ticket prices may include additional service charges, delivery, and handling fees, as defined on each order. The Site and Sellers are not directly affiliated with any performer, sports team, or venue; the Site does not act as a primary sale box office, unless otherwise stated. By agreeing to these Terms, Member agrees that the purchase price for tickets on their order does not reflect the original purchase price of the ticket and may be either higher or lower than the original purchase price. All prices are in United States Dollars (USD) unless otherwise specifically stated. The Site cannot confirm the price for any products or services purchased on the Site until after an order is completed by Member. Despite TFL’s best efforts, some tickets listed on the Site may be priced incorrectly. At our sole discretion, if we discover the actual correct price is higher than the stated price, we will either complete the order at the originally stated price, contact Member to inform them of the different price with an option to purchase, or cancel Member's order and notify Member of such cancellation.

  5. Ticket Availability and Event Listings.
    1. We do not guarantee ticket availability. All ticket listings on the Site are a unique set of tickets from an individual Seller. Some listings on the Site may only be representations of available tickets or an offer by the Site to obtain tickets and not actual seat locations or currently available tickets. Occasionally, tickets ordered may no longer be available at the price or in the quantity originally ordered at the time the order is received. If equivalent or better seat locations are available at the same price, the Seller may fill the order with the alternative seat locations.
    2. We do not guarantee the accuracy or completeness of event information on Site, including but not limited to event names, locations or venues, start times or dates. Event start times may be subject to change without notice. Changes to event details may be done at the discretion of the venue, performer, promoter, or other party responsible for the event each of which are unaffiliated with us and we have no control over such changes, nor will we be liable for any such changes.

  6. Orders and Delivery.
    1. Member may contact TFL via email or the phone number listed on the Site to retrieve information about their order. Member should carefully enter all required information when submitting an order. Member is responsible for any errors made when entering their information, errors may result in issues such as a delay in processing the order or in delivery of tickets or in cancellation of order. At the sole discretion of us and/or the applicable Seller, orders may be cancelled or filled with comparable tickets if the original tickets are no longer available. All orders placed on the Site or with the Site’s customer support team are considered pending, until confirmed by the Seller.
    2. All tickets are delivered to Member using the delivery method chosen for the order. Physical shipments may require direct signature at the point of delivery. Member is responsible to provide correct shipping address and email address at the time of purchase. We will not provide refunds if Member provides incorrect shipping information. All tickets will be sent to the Member before the event start time, unless the Member’s order is placed after the start time of the event.

  7. Payment.
    1. Credit Card Charges. Member's credit card will be charged by the Site. If Member has any questions about charges on Member's credit card statement, Member should contact TFL via phone or email. TFL may charge or authorize Member's credit card in advance of confirming ticket availability. If tickets are ultimately found to be unavailable, the Member's credit card will not be charged or Member will receive a full refund for the charged amount.
    2. Payment by Debit Card. In some cases, the TFL may attempt to authorize a debit card multiple times, creating several holds on Member's account. This often happens when a third-party credit card processing company requires additional security verification such as a CVV, Zip Code, or address, or when Member's information is incorrectly provided or mistyped. Though the Site will only clear Member's transaction once, the hold(s) will temporarily lower Member's available balance. Any hold(s) may take up to several days to clear.
    3. Third-Party Payment Platforms. If Member selects to complete a transaction on the Site using a third-party payment platform (PayPal, PayPal Credit, Apple Pay, Venmo, Google pay, ACH, Affirm, Klarna, etc.), such third-party services may be subject to separate policies, terms of use, and or fees of said third parties and Member accepts the same by completing the transaction using the Third-Party Payment Platform. The name on the transaction of Member's Third-Party Payment Platform account may or may not be the Site name. If Member has any questions about the transaction on the Third-Party Payment Platform account, Member should contact TFL via phone or email.
    4. Collecting Payment for Orders. Member agrees that TFL has the right to collect payment for any order if TFL has shipped and/or sent the tickets purchased to Member. If a third-party provider error, system error, or other payment processing error or problem of any kind results in an unprocessed payment and therefore Member's payment method is not charged the total amount due even though the ticket(s) were shipped and/or sent to Member, Member hereby authorizes TFL to collect the amount of the total amount due, unless expressly prohibited by law, through whatever means TFL deems appropriate. Member shall be responsible for any and all legal fees or collection costs incurred by Member, and/or TFL, associated with collecting payment. In no event will we be responsible for such collection costs or legal fees.
    5. Security of Card Holder Data. TFL is responsible for the security of the cardholder data that TFL is in possession of or otherwise stores, processes, or transmits on behalf of the Member in accordance with TFL’s Privacy Policy.

  8. International Orders. International Orders placed by Member may be subject to delayed processing. TFL recommends that any Member placing an order on the Site from outside the U.S. contact their credit card company or financial institution prior to placing an order to prevent unnecessary delays or holds. We shall not be responsible for delays, holds, or any extra fees associated with placing an International Order.

  9. Disputed Charges. By placing an order, Member authorizes TFL to charge Member's method of payment for the total amount, which includes the ticket price, service fees, delivery fees, taxes, and any other optional services or offerings Member agrees to purchase. If Member disputes a charge and it is determined that the charge was valid and not the result of credit card or other payment fraud, TFL has the right to seek payment, including all associated fees, by whatever means it deems appropriate, including but not limited to using collection agencies and legal remedies. TFL may mitigate its damages by relisting the tickets that are the subject of the payment dispute. Member may lose access to any and all tickets purchased if Member files a dispute with their issuer. Member may also be prevented from purchasing tickets in the future from the Site and any other affiliated sites.

  10. Promotional Giveaways. Promotional giveaways and special offers displayed on the Site are administered solely by the applicable team, event or venue and not by us. Promotions may be modified, limited, or subject to eligibility requirements at the discretion of the hosting organization. We do not control, administer, or guarantee any promotion and assume no responsibility for promotional items, quantities, distribution policies, eligibility criteria, age restrictions, timing requirements, or changes to promotional schedules.
The display of a promotion on this site does not form part of the ticket purchase contract and does not modify the terms of sale applicable to tickets. Purchasing a ticket does not guarantee receipt of any promotional item. Failure to receive a promotional item shall not constitute grounds for cancellation, refund, credit, or chargeback of any ticket purchase. Availability is typically limited and may be distributed on a first-come, first-served basis, subject to the team or venue’s official guidelines. For complete and up-to-date promotion details, please refer directly to the team or venue’s official website.

  1. Ticket Holder Behavior Policy. The Member agrees to abide by all rules and policies of the venue where the event is located relating to conduct and behavior. Should the Member be ejected from the event or denied entry for failure to abide by the venue's rules and policies, Member shall be subject to all applicable fines and legal or other expenses associated with the ejection. In addition, all costs associated with the purchase of event tickets will not be refundable. Further, should the ejection result in the loss of the right to use any other tickets, including season tickets at that venue, or the right to purchase other tickets from that venue, Member shall be held liable for all reasonable costs, expenses, and losses associated with said loss, including but not limited to all direct, indirect, vicarious, consequential, exemplary, incidental, special or punitive damages, including lost profits.

  2. Fraudulent Use. To protect Member from fraud, Member may be required to provide additional proof of identity on any order. Proof of identity may include but is not limited to a signed credit card authorization and/or photocopies of public documents such as a state driver's license or federal passport.

  3. Denied Entry to an Event. If Member is having difficulty using the tickets to gain entry to the event at the venue, Member should contact TFL immediately by contacting customer via phone at +1 888-519-6282 or email at support@choiceaccesstickets.com . To be eligible for a refund Member must obtain written proof from the venue showing that Member was denied entry to the event and send that proof along with a description of the circumstances to TFL via email within ten (10) days of the event. Member acknowledges and agrees that no refund (or Point reinstatement) is guaranteed even if Member is denied entry into an event. If Member receives a refund, this will be Member's sole remedy and our entire liability for the denied entry.

  4. Violation of the Terms. We, in our sole discretion, and without prior notice, may suspend or terminate Member's access to the Program or Site, cancel Member's ticket order(s) or exercise any other remedy available to us under these Terms or law or equity. Choice may also at its sole discretion suspend or terminate your Choice Privileges membership if you violate these Terms. Member agrees that monetary damages may not provide a sufficient remedy to Site for violations of these terms and conditions and Member consents to injunctive or other equitable relief for such violations. We may release Member information by operation of law, if the information is necessary to address an unlawful or harmful activity against us or the Site. We are not required to provide any refund to Member if Member is terminated as a Member of this Site.

    3. WE ARE NOT RESPONSIBLE FOR THE PRODUCTS, SERVICES, ACTIONS OR FAILURE TO ACT OF ANY TICKET SELLER, VENUE, PERFORMER, (INCLUDING BUT NOT LIMITED TO THEIR PERFORMANCE, FAILURE TO PERFORM, OR MODIFICATION OF THE PERFORMANCE OR EVENT IN ANY WAY), PROMOTER OR OTHER THIRD-PARTY IN CONNECTION WITH OR REFERENCED ON THE SITE.

  6. Limitation of Liability. Member acknowledges that the Site is a marketplace allowing people to buy and sell tickets to concert, sporting, and other entertainment events. The listings of ticket inventory on Site are provided by third parties (each a ”Provider”). Accordingly, TFL (solely in its capacity as the administrator of the Site), Choice and Provider, are not involved in the actual transaction between Members and Sellers. Therefore, to the fullest extent permitted by applicable law, TFL (solely in its capacity as the administrator of the Site) Choice and Provider shall have no liability arising in connection with your use of the Site.
Regardless of this provision, to the extent that a court of competent jurisdiction imposes liability on us, our liability to Member or any third party is limited to the amounts paid by Member for the purchase giving rise to such liability hereunder, and a refund of such amounts will be Member’s sole remedy and our sole liability hereunder.
  1. Indemnity. Member agrees to indemnify, defend and hold Choice and TFL, and their respective subsidiaries, affiliates, officers, agents, successors, assigns, contractors, representatives, partners and employees, harmless from and against any and all losses, liabilities, claims, demands, suits, actions, penalties, fines, costs and expenses, including reasonable attorneys' fees, made by any third party due to or arising out of Member's participation in the Program or use of the Site, including without limitation Member's acts and omissions, Member’s interaction with any Third Party Content, and Member’s use of the Site to provide a link to another site or to upload content or other information to the Site.

  2. Governing Law. Member agrees that any controversy or claim arising out of or relating to its participation in the Program or use of the Site will be governed by the laws of the State of Maryland without regard to its conflict of law provisions. Member agrees to personal jurisdiction by venue in the state and federal courts of the State of Maryland.

  3. Arbitration and Dispute Resolution.
    1. Any controversy, claim, dispute, or other action, arising out of or relating to the participation in the Program use of Site, any order placed on Site, or these policies including any dispute over the validity, enforceability, or scope of this arbitration provision (a “Claim” or “Claims”) shall be resolved through binding arbitration administered by the American Arbitration Association (the “AAA”) in accordance with its Consumer Rules. If the arbitrator finds that either the substance of the Claim or the relief sought in the Claim is frivolous or that the Claim was brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all such fees will be governed by applicable AAA Rules. In such case, Member agrees to reimburse us for all monies previously disbursed by Site that are otherwise Member's obligation to pay under the AAA Rules. In addition, if Member initiates an arbitration for a Claim for more than US $10,000, the payment of fees will be governed by the AAA Rules. The AAA rules will determine whether the arbitration will take place through written submissions by Member and us, by phone, or in person. We and Member shall both participate in the selection of an arbitrator. Any award issued through arbitration is enforceable in any court of competent jurisdiction.
    2. BY AGREEING TO ARBITRATE, MEMBER ACKNOWLEDGES AND AGREES THAT MEMBER IS GIVING UP THE RIGHT TO LITIGATE (OR PARTICIPATE IN AS A PARTY OR CLASS MEMBER) ANY AND ALL CLAIMS IN COURT BEFORE A JUDGE OR JURY. INSTEAD, A NEUTRAL ARBITRATOR WILL RESOLVE ALL CLAIMS. IF MEMBER DOES NOT WISH TO BE BOUND BY THIS ARBITRATION PROVISION, MEMBER MUST NOTIFY US IN WRITING WITHIN THIRTY (30) DAYS OF THE DATE THAT MEMBER PLACES AN ORDER ON SITE. MEMBER'S WRITTEN NOTIFICATION TO US MUST INCLUDE MEMBER'S NAME, ADDRESS, AND ORDER NUMBER AS WELL AS A CLEAR STATEMENT THAT MEMBER DOES NOT WISH TO RESOLVE CLAIMS WITH US THROUGH ARBITRATION. AN EMAIL SHALL SUFFICE AS WRITTEN NOTICE.
    3. Any arbitration or trial of any Claim will take place on an individual basis without resort to any form of class or representative action (“Class Action Waiver”). Regardless of anything else in this Arbitration Provision, the validity and effect of this Class Action Waiver may be determined only by a court and not by an arbitrator. Member and we acknowledge that the Class Action Waiver is material and essential to the arbitration of any disputes between the parties and is non-severable from the agreement to arbitrate Claims. If the Class Action Waiver is limited, voided, or found unenforceable, then the parties' agreement to arbitrate shall be null and void with respect to such proceeding, subject to the right to appeal the limitation or invalidation of the Class Action Waiver. MEMBER AND WE ACKNOWLEDGE AND AGREE THAT UNDER NO CIRCUMSTANCES WILL A CLASS ACTION BE ARBITRATED.
    4. All Claims brought by Member against either or both of TFL or Choice must be resolved in accordance with this Arbitration and Dispute Resolution Section. All Claims filed or brought contrary to this Arbitration and Dispute Resolution Section shall be considered improperly filed. Should Member improperly file a Claim, we may recover attorneys' fees and costs up to US$1,000 from Member, provided that we have notified Member in writing of the improperly filed Claim, and Member fails to promptly withdraw the Claim after Member receives notice of improper filing from us.

  5. Third Party Content. The Site may feature products, offerings, links, advertisements or other content of third parties (“Third Party Content”). Third Party Content may be subject to additional terms, conditions and privacy or other policies of the applicable third parties.
